This Privacy Policy explains how Applied Lacquer Industries Inc. d/b/a Aprés Nail Inc. (“Aprés Nail”) collects, uses and protects your personal information.

This Privacy Policy describes how your personal information is collected, used, and shared when you visit, make a purchase from apres-nail.myshopify.com and apresnail.com (the “Site(s)”), or purchase our educational programs (“Courses”) that we make available on the Sites. Sites and Courses are collectively referred to as the “Services.”

PERSONAL INFORMATION WE COLLECT

In this Privacy Policy, we use the term “personal information” to refer to information that can be used by itself or in combination with other available information to identify or be associated with you. We may collect the personal information categories listed in the table below.We do not knowingly collect sensitive personal information or personal information of children under 18 years of age.

We do not collect any sensitive personal data as defined by the applicable laws and we do not draw inferences from your personal information to build your consumer profile.

Directly from you. For example, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number. We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).

Legal or Regulatory Purposes: We share information with governmental and regulatory entities as necessary to fulfill our legal obligations, comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Do Not Sell or Share My Personal Information

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by following the same link.

Opt-Out Preference Signal. You may opt out by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal). Cookies enable Aprés Nail to measure and analyze the visits to the Services and collect data on the activities of users of Services. We use Google Analytics and/or other third-party data analytics services to place the cookies, track Services usage data, and provide reports to us.Aprés Nail does not disclose any directly identifying personal information to a third-party data analytics service. However, the service may monitor a user’s visits to the Services and combine this data with data from other websites monitored by the same service provider and then use the aggregated findings for its own commercial purposes. Describe your request with sufficient detail for us to properly understand, evaluate, and respond to it.

If you wish to submit a verifiable consumer request on behalf of another individual, we will also need sufficient information to verify that the individual is the person about whom we collected personal information and that you are authorized to submit the request on their behalf. For requests to know, access, correct or delete personal information, we may ask you to provide sufficient evidence to show that you have provided the authorized agent signed permission to act on your behalf, verified your own identity directly with us pursuant to the instructions set forth in this Privacy Policy, and directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf.

RESPONSE TIMING AND FORMAT

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

NOTICE OF FINANCIAL INCENTIVE/ REWARDS PROGRAMS

We offer our customers a rewards program that provides certain perks, such as rewards and exclusive offers. We may also provide other programs, such as contests, or other similar promotional campaigns. When you sign up for one of these rewards programs, we typically ask you to provide first name, last name, email, and password for general accounts, for professional accounts we collect: first name, last name, email, phone number, preferred pronouns, business website, birthdate. Because our rewards programs involve the collection of personal information and offering of certain benefits, they might be interpreted as a “financial incentive” program under California law or a “bona fide loyalty program” under Colorado law. Under the California law, the value of your personal information to us is related to the value of the free or discounted products or Services, or other benefits that you obtain or that are provided as part of the applicable program, less the expense related to offering those products, Services, and benefits to Program participants.

SECURITY AND DATA RETENTION

Aprés Nail maintains administrative, technical, and physical safeguards to protect the security, confidentiality, and integrity of personal information appropriate to the nature of the information we collect. While the measures we implement are intended to reduce the likelihood of security problems, we cannot guarantee that these measures will prevent unauthorized access to your Investor Information. In particular, information transmitted over the Internet may be beyond the control of Aprés Nail, and you are advised that such transmission may not be secure.

We will retain your personal information, including your Order Information, for our records as long as we provide Services to you, as necessary to comply with our legal obligations, resolve any disputes, and enforce our agreements unless deleted earlier per your request.

Our Services permit you to register an account. When you create an account, you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else who has obtained your password, even if that person was not authorized by you. You should notify us of any unauthorized use of your password or account, and, if any unauthorized use is suspected, you should immediately reset your password.

If you have reason to believe that your interaction with us is no longer secure or your security has been compromised, you must immediately notify us of the problem by contacting us as provided below.

MINORS

The Site is not intended for individuals under the age of 18, and we do not intentionally collect personal information from individuals who we have reason to believe are under the age of 18. If we learn that we collected any personal information of children under the age of 18 we will immediately delete such information and the corresponding account.
